| Osmanlı Devleti’nin son döneminde başlayarak Cumhuriyet’in kuruluş devrine kadar süren hukuki modernleşme sürecinde yaşanan fikri tartışmalar ve bu sürecin İslam medeniyetine etkisinin ne yönde olduğu bugüne dahi ışık tutacak önemli bir konudur. Öyle ki, Batı medeniyeti karşısında çok yönlü bir gerileme dönemine giren, İslam dünyasının ve Osmanlı Devleti’nin bu duruma çare olarak neler yapması ve nasıl bir tutum takınması gerektiği önemli bir mesele olarak varlığını hissettirmişti. Osmanlı Devleti’nde Tanzimat dönemi ile başlayan medeniyet tartışmaları en çok da medeniyetin görünen yüzü hukuk alanında varlığını hissettirmekteydi. Hukuki sistemin değişmesi karşısında bu değişimin niteliği, yönü ve dozajı hususunda Osmanlı Devleti’nde devlet adamları, fikir adamları ve ulema arasında yoğun bir tartışma ortamı yaşandı. Genelde İslam medeniyeti ve özelde hukuk alanında yaşanan bu tartışmalarda İslam dünyasındaki gerilemeye çözüm olarak Batı’dan hangi alanlarda ne kadar ve ne şekilde yararlanılması gerektiği, İslam’ın terakkiye mani olup olmadığı ve hukukta milli kaynakların yeri konusunda günümüze de ışık tutan verimli fikir denemeleri yaşanmıştır. Tarihsel süreç içerisinde Batı medeniyeti ile olan çetin karşılaşma esanasında İslam medeniyet tarihi açısından çok değerli olan fikir tartışmaları, sorunların çözümüne yönelik aranan çareler ve medeniyetin en önemli ögelerinden biri olan hukuk alanında yaşanan değişim ve dönüşüm çalışmalarını etüd edeceğimiz bu çalışma geçmişin bir tetkiki olmanın çok ötesinde bugüne ve geleceğimize de ışık tutacak nitelikte olay, olgu ve düşünceleri ihtiva etmektedir. | The ideological discussions during the period of law modernization which lasted beginning from the last days of the Ottoman Empire until the foundation of the Republic and how this period effected the Islam civilization is an important subject which enlightens even today. In fact, it was crucially felt that what Islamic world and the Ottoman Empire which had a multiple retreatment period at that time do against and how they should react to this situation. The civilization discussions which began with the Tanzimat Reform Era were felt mostly in the field of law which was the exposed face of civilization. Against the change in the system of law, there was an intense discussion time about the characteristics, aspects and dosage of this change among the statesmen, the intellectuals and ulemas in the Ottoman Empire. In these discussions, generally in Islam civilization, specifically in the Law area, as a solution for the retrogress in the Islam world, there have been fruitful ideological studies that enlighten us even today about the subjects such as in which areas and in which ways we should be inspired from The West, whether Islam is detrimental to development, and the place of national resources in Law. This study, which we are going to investigate the ideological discussions which were very significant historically throughout the historical process, during the hard confrontation with the west civilization, the steps taken towards the solution of the problem and changes and developments in law which is one of the most important factors of civilization, includes events, facts, and thoughts that will hold light on our future beyond just being an investigation of history.
